  • Note on Math: The "USPTO & Admin Fee" is calculated as ($150 x Number of Classes) + $45 flat admin fee.

Statement of Use (SOU)

The Statement of Use is the final milestone in your trademark journey!

Because we filed your application as "Intent to Use," the USPTO has "reserved" your name, but they won't officially register it until you prove your brand is live and active in the marketplace. This filing converts your "Approved" status into a "Registered" trademark.

What You’ll Need to Provide:

To finish the process, we must submit a Specimen. This is not a logo file or a mockup; it is a real-world "snapshot" showing your brand in action exactly as it appears in your application.

Examples for your industry:

  • For Fintech & App Founders: A screenshot of your app's "Launch Screen" or a functional website showing your service description alongside a "Sign Up" or "Open Account" button.

  • For Authors & Creators: A photo of your book’s front cover, a screenshot of your eBook on a retailer site (Amazon/Apple Books), or a marketing brochure specifically offering your creative services.

  • For Physical Goods: A clear photo of your product with a permanent label, a clothing hang-tag, or the shipping packaging showing the brand name.

Quick Tips for a Passing Specimen:

  • No Mockups: The USPTO will reject "Photoshopped" logos or printer's proofs. It must be a photo of the actual finished product or a live website.

  • Show the Connection: For services (like Fintech), the brand name must be shown right next to a description of what you actually do.

  • URL & Date: If providing a website screenshot, we must include the URL and the date the page was accessed (I will handle this part for you during our session!).
